”The Court of Appeal Makurdi today dismissed an appeal filed against the nomination of Rt.Hon Herman Hembe, Member representing the Vandeikya/Konshisha Federal Constituency by one Mr. Simeon Yongo.
‘The three man panel of justices agreed with the submissions of counsel to Hon Hembe Barr.Samson Blair Luga that the appeal was dead on arrival having not complied with the provisions of constitution ab initio.
Counsel to INEC Mr Collins Nanshal also urged the court to strike out the appeal.
In the course of the proceedings, the Presiding Justice frowned at the dishonorable conduct of the lawyers to Mr Yongo, especially Chief Umoanwan on the grounds that they attempted to mislead the court and for failing to properly advise their client.
Mr. Simeon Yongo
The court slammed the sum of #200,000.00 against Mr. Simeon Yongo as costs in favour of Hon.Hembe.
Reacting, counsel to Hon.Hembe Mr.Luga hailed the decision of the Court of Appeal and promised to recover the judgment sum on behalf of his client by all legal means within few weeks.”
It has been documented that Hembe recently beat Mrs Dorathy Mato at the poll and he did same when she challenged Hembe’s victory at court.
